Eduardo Gonzalez killed Debra Hyton, 48, in May 2013 by hitting her in the head with a blunt object. He pleaded guilty to first-degree murder, and the state sentencing guidelines called for a sentence of 162 months in prison. The jury recommended a sentence of 144 months.

On Wednesday, Gonzalez’s attorney, Kevin Short, argued for a sentence that reflected his client’s remorse and acceptance of responsibility for his crime.

Short argued that Gonzalez’s character, history and prospects for rehabilitation suggest a lesser sentence of 96 months.

“He’s lived in the United States for 20 years, he’s never been in trouble before,” Short said.

The prosecution countered that the 130-month sentence was appropriate given Gonzalez’s history of drug use and the fact that he struck Hyton after the couple argued about who should be driving.

“Mr. Gonzalez was caught doing it,” Assistant Hennepin County Attorney Doug Alder said. “He did not kill her because he’s sorry for it.”

Gonzalez, 47, had been working as a dental technician in Minneapolis. In 2009, he pleaded guilty to unlawful possession of marijuana after being stopped for speeding.

He had also pleaded guilty to illegally possessing a gun after a domestic violence charge against him was dropped. In 2004, he pleaded guilty to misdemeanor domestic assault, which also involved Hyton.

Gonzalez met Hyton in 1999, and they married in 2000. The couple had five children. Hyton is survived by two of their children.

Defense attorneys had argued that Gonzalez’s drug problem was a symptom of mental illness. But a psychiatrist testified that although Gonzalez has been diagnosed with depression and has used prescription medication for that, he is not mentally ill.

As a dental technician, Gonzalez had access to potentially deadly drugs, the psychiatrist said. He also had access to guns because his children often stayed with him, and he kept the weapons to protect them. 0b46394aab
